Disposition Authorities for Individual Classifications for Headquarters Case Files. Part B: Classification 158. Labor Management Reporting and Disclosure Act of 1959.

This classification, established September 22, 1959, relates to investigations of violations of that portion of the Labor Management Reporting and Disclosure Act of 1959 (Public Law 86-257 Section 504) which prohibited Communist party members from holding certain office or employment in the labor area. During 1960 and 1961 the FBI opened 370 cases in this classification. Because of constitutional questions about these investigation, only 70 investigations were undertaken between 1962 and 1965. During the latter year, by a 5-4 vote in the Artie Brown case, the Supreme Court held as unconstitutional the anti-communist provisions of the Act.

The FBI established this classification when it assumed responsibility for ascertaining the protection capabilities and weaknesses of defense plants. Each plant survey was a separate case file, with the survey, supplemental surveys, and all communications dealing with a plant insofar as plant protection was concerned, filed together.
